These Sales Terms and Conditions manage the offer and sale to the consumer of products through the Cantine Gulino website (hereinafter “Site”) and are formulated and provided in compliance with the provisions of Legislative Decree 6 September 2005 n. 2016 (c.d. “Consumer Code”) and any other law applicable to electronic commerce.

PARTS OF THE CONTRACT – TRADE POLICY
The parts of the contract are:

– Enofanusa srl (Cantine Gulino), with registered office in Siracusa, Viale Tica 127 and Partita IVA number 01333240891;

– The “Customer”: the final consumer, or any natural person or legal person who purchases through the Site.

Enofanusa srl (Cantine Gulino) offers its products for sale on the website and carries out traditional commerce and e-commerce activities for its users (hereinafter referred to as the “Consumer”).

The Customer who makes purchases on the Cantine Gulino website declares to be of age.

APPLICATION AND CHANGES TO THE SALES CONDITIONS
Before making purchases through the website, the Customer declares to have read and understood these Sales Terms and Conditions as well as all the information provided during the purchase process and the contents of the following sections: Terms of use, Privacy Policy and to fully accept them without reservation.

Cantine Gulino reserves the right to change the contents of these Sales Terms and Conditions and the other documents listed above, highlighting them on the Website. It is therefore a good idea to periodically consult the Site to check for updates or changes. Any changes will be effective after publication on the Site.

The Conditions of Sale applicable to a purchase will always be those in force at the time the order is made.

PRODUCT CHARACTERISTICS AND PRICES
Cantine Gulino offers for sale on the Site only products marked with trademarks of their own ownership.
The essential characteristics of the products are presented on the website within each product page.
The products are offered for sale at the price indicated on the Site at the time the relevant Purchase Order is made. Product prices may be subject to changes and variations. We invite you to check the final sale price before submitting the relevant order form thus confirming the purchase.

The prices shown on the Site do not include the additional costs for shipping and delivery which, where applicable, are in any case made known to the Customer through specific indications present on the Site and specifically referred to during the purchase procedure.

PROCEDURE FOR CONCLUSION OF THE CONTRACT
To purchase one or more products on the website, the Customer must fill in and send the respective order form (hereinafter “purchase order”) to Cantine Gulino by following the instructions progressively provided during the purchase procedure. All the steps of the purchase procedure are clearly described through the pages of the site and related texts and graphics.

In the purchase order, displayed in its entirety immediately before the conclusion of the contract and in any case before any payment is made, summary information is provided about the essential characteristics of each product ordered, the price (including all applicable taxes or duties) and any applicable shipping costs and / or expenses.

With the electronic transmission of the purchase order, the Customer unconditionally accepts and undertakes to observe these Terms of Sale in the relations with Cantine Gulino regarding the purchase. If you do not agree with any of the terms set out in the Terms of Sale, we therefore ask you not to submit the Purchase Order.

Following the receipt of the Purchase Order, Cantine Gulino will verify the availability of the product ordered and, upon completion of this verification, will send the Customer an e-mail confirmation of receipt containing these Conditions of Sale, including the provisions relating to the right of withdrawal, and therefore all the information already contained in the summary of the commercial and contractual conditions displayed before proceeding with the sending of the Purchase Order.
The sales contract is deemed to be concluded and finalized when Cantine Gulino sends the Customer the electronic confirmation of receipt of the purchase order completed and sent by the Customer, after verifying the correctness of the data provided and transmitted.

The purchase order will be stored in our database for the period of time necessary for the evasion and in any case not later than the legal terms.

Cantine Gulino reserves the right not to process purchase orders that are incomplete or incorrect or inconsistent with the commercial policy referred to in paragraph 1 of these Conditions of Sale, as well as in the event of unavailability of the ordered products. In these cases we will inform you that the contract has not been concluded and that Cantine Gulino has not followed the purchase order specifying the reasons.

In particular, if the products presented on the Site are no longer available or for sale at the time of your access to the Site, or at the time the order form is sent, Cantine Gulino will promptly notify you of any unavailability of the products. In such cases the contract will not be finalized and, if already concluded for any reason, it will be considered automatically terminated and no amount will be charged to you.

Any contractual or extra-contractual liability for direct or indirect damage to people and / or things caused by the non-acceptance of an order for the reasons mentioned above is expressly excluded.

SHIPPING AND DELIVERY
Products purchased through the Site will be shipped by Cantine Gulino by courier to the address indicated in the purchase order within the timeframe indicated by the courier.

In the event that the courier fails to deliver for any reason, he will leave a notice of passage showing the numbers useful for setting a new delivery date.

PAYMENTS
Payment for orders can be made:

(i) by bank transfer (in this case, the order will be effective only and exclusively after the customer has sent an email to the Cantine Gulino with the attestation of the transaction on the company’s current account);
(ii) with a credit card belonging to the Visa / MasterCard / American Express circuit;
(iii) through the PayPal platform. By selecting it during the purchase procedure, you will be redirected to the PayPal secure servers where you will pay with Paypal, if you already have an account, or simply access with your own credentials to complete the payment by credit card, bank account or electronic purse.
In case of payment by credit card, the financial information (for example, the number of the credit / debit card or the date of its expiry) will be forwarded, via encrypted protocol, to the banks that provide the related payment services electronic remote, without any third party having access to it in any way. Furthermore, such information will never be used by Cantine Gulino except to complete the procedures relating to your purchase and to issue the relative refunds in the event of any product returns, following the exercise of your right of withdrawal, or if it becomes necessary to prevent or report the commission of fraud through the Site to the police.

Upon completion of the order, it will be possible to request the issuance of the tax invoice as indicated during the purchase procedure. We inform you that it will not be possible to request the issue of the invoice once the procedure has been completed and the relevant Purchase Order has been sent.

RIGHT OF WITHDRAWAL (art. 52 and subsequent legislative decree 6th September 2005 n.206)
The Customer has the right to withdraw from the contract by means of a communication aimed at identifying the Customer and the contract, from send by registered letter with acknowledgment of receipt to the following address:

Alternatively the communication can be sent, within the same term, by e-mail (info@cantinegulino.it).
The withdrawal is effective only if exercised within and no later than 30 days starting from the date of delivery of the products. As soon as the communication of the withdrawal is received, Cantine Gulino will contact the Customer without delay to communicate the address of the place where the products will be returned; the Customer will then take care of returning the products to Cantine Gulino in accordance with these indications no later than the following 14 days. Cantine Gulino, in the 14 days following receipt of the communication concerning the withdrawal, will fully refund the amount paid by the Customer. The costs of returning the products to Cantine Gulino shall be borne by the Customer.

An essential condition for exercising the right of withdrawal is the substantial integrity of the products to be returned.

LEGAL GUARANTEE OF CONFORMITY
In accordance with the provisions of Title III, Part IV of Legislative Decree 206/2006 (so-called Consumer Code) Cantine Gulino guarantees that the products purchased on the Site are free from defects, without prejudice to all rights and remedies due to the consumer in application of the rules of the Consumer Code, including the right to restoration without charge by repair or replacement and, alternatively, the other remedies provided for by art. 130 of the Consumer Code. By “defect” we mean a significant limitation or reduction in the product’s suitability for use in accordance with the art. 129 of the Consumer Code. All defects resulting from negligent or improper use of the product are not covered by this warranty. The defective product, if still covered by the guarantee, must be sent to the site together with a copy of the documents suitable to certify the purchase and the delivery date. APPLICABLE LAW
The Conditions of Sale are governed by Italian law and in particular by the legislative decree 6 September 2005 n. 206 (c.d. Consumer Code), with specific reference to the legislation on distance contracts and by the legislative decree 9 April 2003 n. 70 on certain aspects concerning trade.

The competent court for the resolution of any dispute will be the one provided for by the Italian legislation in force at the time of the conclusion of the contract.
